Payment and Refund Policy

1. Some licenses for EZPCBackup are based on the number of computers registered, the volume of storage used, or both. Where your license fees are based in full or in part upon the amount of storage you use, your bill for EZPCBackup will be based upon the greater of the storage amount shown on your computer or the storage amount maintained by EZPCBackup, excluding the benefits of any data compression, file duplication or similar techniques performed by EZPCBackup. The calculation of a storage bill will be based upon the price(s) for the EZPCBackup license and may be based upon the average storage used during a month, the storage as of the end of the month, or another storage measure, depending on which services you have selected at the time of registration or renewal.
2. EZPCBackup only accepted method of payment is with a credit card.
3. Accounts will not be activated or reactivated without prior payment.
4. All fees and renewal fees are due on or before the due date of the renewing account.
5. Incomplete, incorrect or questionable signup information can result in an account NOT being activated.
6. Any losses or expenses experienced by the Customer, due to actions taken by EZPCBackup in response to Customer non-payment, are not the responsibility of EZPCBackup.
7. By purchasing EZPCBackup services, you are agreeing to allow EZPCBackup to place your account on a recurring payment plan. The account will automatically be re-billed according to the terms of the plan you select.
8. You grant EZPCBackup permission to charge your credit card for any and all services you request and any renewals thereof.
9. If EZPCBackup is unable to process a payment for your plan by its due date, your account will be suspended for five days (the "suspension period") or until payment is successfully processed. If EZPCBackup is unable to process a payment for your plan within the suspension period, your account will be cancelled for non-payment and you will not be able to access your account.
10. EZPCBackup will use commercially reasonable efforts to make your Data available for you to download for a period of three (3) days after account termination. EZPCBackup has no obligation to provide you with a copy of your Data and may remove and discard any backup data.
11. If an account has been suspended for non-payment, it will only be reactivated upon payment of all overdue fees.
    
12. It is a violation of this Agreement for you to misuse or fraudulently use credit and debit cards. A determination of such misuse or fraudulent use shall be at the sole discretion of EZPCBackup. Further, EZPCBackup may report all such misuses and fraudulent uses (as determined by EZPCBackup in its sole discretion) to appropriate government authorities, credit reporting services, financial institutions and credit card companies.
13. Fees paid for monthly plans are non-refundable.
14. Refunds on multi-period plans (i.e. annual and biennial plans) may be granted on a prorated basis for the unused portion of the period purchased, in whole month increments, and not including the current month.
15. If you do not wish to continue services with EZPCBackup, or do not wish to renew your account, it is your responsibility to cancel your account prior to your renewal date to avoid further charges.
16. You are free to cancel your account at any time. Similarly, EZPCBackup reserves the right to cancel any account at any time, for any reason, including, but not limited to, a breach of this Agreement.You have ninety (90) days to dispute any charge or payment processed by EZPCBackup.
